Both parties meet together win an impartial third person (the mediator). The mediator uses a structured process and basic communication skills to help those involved work out the details of property divisions.

The steps include:

bullet    identifying the main issues to be resolved,
bullet    expressing what each party wants and why it is  important to them,
bullet    gathering information to assist in making sound decisions,
bullet     generating and exploring possible solutions,
bullet     reaching agreements that acceptably meet each person's needs,
bullet      coming to an overall agreement that the individuals involved have created together with the help of a mediator.
